Party Now, Pay Later Agreement

1. Overview of the Party Now, Pay Later Installment Agreement

The Party Now, Pay Later Installment Agreement includes the Final Payment Schedule, which is sent to the Client by the Company after completing a booking. The schedule will include:

• A non-refundable deposit of $150,
• The first installment payment,
• The remaining payment amounts and due dates.
• No installment payment(s) can exceed past events date
• Remaining balance payment is required 7 days or 48 hours prior to events date (whichever is soonest)
• No interest or finance charges apply.

The Final Payment Schedule replaces and supersedes any preliminary payment schedule provided earlier.

2. Payment Options and Third-Party Providers

The Party Now, Pay Later option may be processed through third-party payment providers such as Stripe, Affirm, and Klarna.

By selecting this option, the Client also agrees to the terms and conditions of these providers. Any late fees, interest charges, or payment disputes related to these companies are governed by their individual terms and cannot be modified or reversed by 360 Photo Swirl.

3. Promise to Pay

By entering into this Agreement, the Client agrees to pay all amounts listed in the Final Payment Schedule according to the dates and payment amounts indicated.

There are no finance charges and no interest payments associated with this Agreement. However, failure to make timely payments may result in late fees as described below.

4. Use of Proceeds and Authorization

By electronically accepting this Agreement and completing a booking, the Client authorizes the Company to collect the first payment amount, which establishes the Client's payment schedule. The Client agrees to pay all amounts disclosed in the Final Payment Schedule, including any add-ons or upgrades selected.

This Agreement constitutes a personal payment obligation for services rendered for personal or event use.

5. Installment Payments

Upon booking with the Party Now, Pay Later option, the Client will select an eligible U.S.-issued credit or debit card ("Payment Method").

In addition to the initial deposit and first payment, the Client agrees to make one (1) or up to three (3) remaining installment payments ("Installment Payments") as shown in the Final Payment Schedule. The Client must ensure sufficient funds are available for all scheduled payments.

Only services booked through the Company's official booking page are eligible for the Party Now, Pay Later option.

6. Late Payments

There are no finance charges or interest fees under this Agreement.

However, if an installment payment is not received within ten (10) days of the due date (or any grace period required by law), a Late Fee may be charged up to a maximum of $200.

The total Late Fees for any single order will not exceed 25% of the total booking value.

7. Delinquency and Default

A Client is considered delinquent if any payment is not made on time or as required by this Agreement.

If the Client becomes delinquent, files for bankruptcy, or breaches any material term of this Agreement, the Company reserves the right to:

• Declare the entire remaining balance immediately due and payable,
• Restrict or suspend the Client's access to the Party Now, Pay Later option,
• Refuse or cancel future bookings.

8. Approval and Cancellation

All Party Now, Pay Later payment options are subject to Company approval.

If a booking is associated with a delinquent account or prior unpaid balance, the Company may, at its discretion, deny approval or cancel the booking without further obligation. In such cases, any payments made may be retained by the Company, and the Client will not be charged further.

The Client acknowledges and authorizes the Company to verify their identity and account status through third-party systems as needed.

9. Consent to SMS and Email Communications

By entering this Agreement, the Client expressly consents to receive communications from 360 Photo Swirl, including but not limited to:

• Booking updates,
• Payment reminders,
• Service notifications,
• Marketing and promotional materials.

These communications may occur via SMS, text message, email, or automated voice call. Standard carrier rates may apply.

Clients may opt out of marketing communications at any time by clicking "unsubscribe" in an email or contacting info@360photoswirl.com.

However, opting out of service-related messages may restrict access to the Party Now, Pay Later option or booking notifications.

10. Miscellaneous

This Agreement remains effective until all balances are paid in full or the Agreement is otherwise canceled or refunded.

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall continue in full effect.

This Agreement represents the entire understanding between the Client and 360 Photo Swirl and supersedes any prior agreements or communications related to payment terms or service booking.

By completing a booking through our website and selecting a Party Now, Pay Later option, you acknowledge that you have read, understood, and agree to all terms of this Agreement.
